1. About PropertyKete

PropertyKete (“we”, “us”, “the service”) operates propertykete.co.nz, an online property intelligence platform for New Zealand. The service aggregates and presents publicly available, official, and licensed data about properties to help buyers, renters, investors, and advisers understand what is known about a property from available sources.

By accessing or using PropertyKete, you agree to these terms. If you do not agree, do not use the service.

2. Not professional advice

PropertyKete is not: a LIM (Land Information Memorandum), a registered valuation, legal advice, engineering advice, building inspection, insurance assessment, planning advice, or any other form of regulated professional advice or assessment.

Reports and scores are informational estimates derived from available public datasets. They do not:

  • Guarantee that a property is safe, insurable, mortgageable, or suitable for development.
  • Constitute or replace a formal property valuation.
  • Substitute for advice from a solicitor, engineer, builder, surveyor, planner, or insurer.
  • Confirm compliance with resource consents, building consents, or district plan rules.

Before making any property purchase, investment, or development decision, you must independently verify all material matters with qualified professionals and obtain a LIM from the relevant territorial authority.

3. Data accuracy and completeness

PropertyKete sources data from third-party providers including LINZ, GNS Science, Auckland Council, Stats NZ, Ministry of Education, MBIE, and OpenStreetMap. We make reasonable efforts to keep data current, but:

  • Datasets may be incomplete, out of date, or not available for all areas of New Zealand. Where data is unavailable, this is explicitly shown — it does not mean there is no risk.
  • Hazard maps and spatial data represent known conditions as of the dataset date. They may not reflect recent changes to flood extents, fault mapping, or coastal erosion.
  • Scores and ratings are derived estimates, not authoritative assessments. They are presented with a direction label (higher = more risk, or higher = better outcome) to prevent misinterpretation.
  • Coverage is limited to Auckland, Wellington, and Christchurch for some datasets at launch. Nationwide datasets (GNS, LINZ, schools) apply where available.

4. Permitted use

You may use PropertyKete to:

  • Research properties for personal, investment, or professional purposes.
  • Share individual property report links with your solicitor, agent, or insurer.
  • Save and reference reports as part of your own due diligence process.

5. Prohibited use

You must not:

  • Scrape or bulk-download PropertyKete data by automated means (bots, crawlers, scripts, API harvesting) without written permission. This applies regardless of whether you have a paid account.
  • Redistribute, resell, or republish PropertyKete report content or data as a standalone product without a commercial licence from us.
  • Represent PropertyKete reports as LIM reports, formal valuations, engineering assessments, insurance assessments, or legal opinions.
  • Use the service to make automated lending, insurance underwriting, or investment decisions without human review and independent verification.
  • Attempt to gain unauthorised access to accounts, data, or infrastructure.

We reserve the right to suspend or terminate access for violations of these prohibitions.

6. Intellectual property

The PropertyKete platform, scoring methodology, and presentation layer are our intellectual property. Underlying data remains subject to the licences of the original data providers (CC BY 4.0 for LINZ and Stats NZ; open attribution for GNS and MoE; ODbL for OpenStreetMap).

Report content you generate about a property you own or are purchasing may be shared and used for your personal due diligence purposes.

7. Subscriptions, billing, and cancellation

PropertyKete offers a Free plan and one paid product, PropertyKete Pro. Pro is a recurring subscription available on weekly, monthly, or annual billing. Reports are not sold individually. All prices are in NZD and include GST.

Payments are processed via Stripe. Your subscription renews automatically at the end of each billing period at the price for the interval you selected, using your saved payment method, until you cancel. The billing interval you choose affects price and renewal frequency only — every paid interval provides the same Pro features.

You may cancel at any time from the customer portal linked on your account page. Pro access continues until the end of the billing period you have already paid for, after which your account reverts to the Free plan. We do not provide partial refunds for an unused portion of a billing period except where required by the Consumer Guarantees Act 1993 or Fair Trading Act 1986.

We may apply reasonable fair-use limits on report generation to protect the service from abuse and excessive automated use. Reports and personal context you have already saved are not affected by such a limit.

We may change subscription pricing. Where we do, we will give you notice before the change applies to your renewal, and you may cancel before that renewal if you do not accept it.

8. Limitation of liability

To the maximum extent permitted by New Zealand law, PropertyKete’s total liability to you for any claim arising out of your use of the service is limited to the amount you paid for the subscription period giving rise to the claim (or $0 for Free-plan use).

We are not liable for any loss arising from: reliance on incomplete or out-of-date data; a property purchase, sale, or investment decision made using PropertyKete reports without independent professional verification; or service unavailability.

Nothing in these terms limits liability for fraud, wilful misconduct, or liability that cannot be excluded under the Consumer Guarantees Act 1993.

9. Governing law

These terms are governed by the laws of New Zealand. Any dispute arising from your use of PropertyKete is subject to the exclusive jurisdiction of the courts of New Zealand.

10. Changes to these terms

We may revise these terms from time to time. The effective date at the top of the page will reflect the most recent revision. Continued use of the service after a change constitutes acceptance of the updated terms.
